Application for Trade Account

• All invoices are to be paid 14 days following the date of the invoice.
• Any claims arising from the invoices must be made within 7 working days of receipt of the invoice.
• By submitting this application, you authorise YumaPOS Australia to make inquiries into the business / trade  references that you have supplied.
• By submitting this application, you agree that the supply of any goods and service will be subject to our Terms & Conditions that are available online.

In consideration of YumaPOS Australia ( PGTA Pty Ltd ABN 59 691 097 355 ), also known as YumaPAY Australia, granting to the Customer named above credit in accordance with our published Terms and Conditions, I / We ( also referred to as the Guarantor/s ) :

1. Guarantee the due and punctual payments to YumaPOS Australia of all monies which are now payable and which are from time to time due by the Customer to YumaPOS Australia under the credit facility.
2. Indemnify YumaPOS Australia against any loses, charges and expenses which YumaPOS Australia might incur as a result of any default by the Customer under the credit facility or the enforcement of this guarantee,  including but not limited to the costs of collection and legal costs.

I / We further agree and acknowledge that :

1. The Terms and Conditions of Credit are available for reviewing on request
2. The obligations under this Guarantee are continuing and will not be affected by YumaPOS Australia granting any extension, waiver or indulgence to the Customer, any variation of the credit facility by YumaPOS Australia, the Customer becoming subject to external administration or the refusal of YumaPOS Australia to supply further credit to the Customer.
3. If there is more than one Guarantor, that the terms of this Guarantee are binding on all Guarantors  jointly and severally.
4. YumaPOS Australia may exercise rights under this Guarantee without first having exercised or exhausted all its legal rights against the Customer or any other Guarantor.
5. A guarantor may revoke his Guarantee in accordance with this clause by delivering written notice to YumaPOS Australia. Such notice may be combined with notice of vacation of office within 14 days. Revocation does not take effect until written acknowledgement of receipt of the notice by YumaPOS Australia. Revocation or release in respect of the Guarantor will not operate to discharge the Guarantor from any obligations with respect to liabilities arising before the date of written acknowledgement by YumaPOS Australia, or operate to discharge the liabilities of any other Guarantor.
6. YumaPOS Australia may obtain information about me / us from any credit reporting agency or credit provider for credit reference purposes and may disclose information about me / us and this Guarantee to a credit reporting agency.

The laws of Western Australia will dictate the resolution of any disputes related to this Agreement.

Before signing this APPLICATION FOR TRADE ACCOUNT & GUARANTEE FORM, the undersigned fully understand the obligation/s they have entered into.
